JUST IN: Bombay HC slams Arbaaz Khan's last min plea; allows 'Sardar Gabbar Singh' release

Mumbai, April 8, 2016: The Bombay high court slammed the practice of film producers coming for urgent “last minute” to stall release of a film, saying these last-minute luxury applications arrogated by plaintiffs should not be tolerated; they come at very considerable cost, not just in terms of judicial time spent, but in time stolen from other litigants waiting in queue.
The court declined to stay the April 8 release of a south Indian film ‘Sardar Gabbar Singh’ which Arbaaz Khan productions sought to stall after alleging that it had tried to copy its “Dabangg franchise.’
Justice Gautam Patel said he had to hear the matter all day and then spent much time on the order, time which other litigants with more pressing concerns were deprived off.
Significantly, however, the court accepted that the cheater of Chulbul Pandey is unique but it also said that the character of Gabbar Singh is different. Lawyers for Arbaaz Khan production said it was a landmark judgment on copy right of a character in a film and that it was the first such order.
